License terms for the use of music and sounds on www.gameaudio.net

§ 1 Conclusion of contract

Through the aquisition of music or sounds (hereafter “music”) on this website, a license-contract is archieved between “Audioproduktion Geiger&Reinbott GbR”, Partners Bernard Geiger and Dag Reinbott, Hartlebenstraße 9, 12587 Berlin, Germany (hereafter „licensor“) and the purchaser (hereafter “licensee”) pursuant to this agreement, related to the corresponding music

The licensor is owner of all user rights for all offered music. The music is protected by copyright law, national and international. Creators of the music are Bernard Geiger or Dag Reinbott. The music on www.gameaudio.net does not require any permission from a collection society (e.g. GEMA in Germany) or rights of third parties. All exploitation rights rest with the licensor.


§ 2 Rights of use

(1) The licensor grants the licensee a non-exclusive, temporally, territorially and substantively limited right of use for the respective music and the use agreed. Licensee will neither become owner of the music nor is the licensee allowed to transfer the rights of use to third parties or grant third parties additional rights.

(2) The granted rights of use are limited. The rights of use for the respective kind-of-use or the respective license-type is temporally unlimited, unless otherwise stated under § 3. Such a limitation is valid as of conclusion of the license-contract, unless otherwise stated. The territorial restrictions and/or application restrictions are regulated in § 3 “License types” (kind-of-use). The right of use is only granted for the respective kind-of-use which meet the respective license type.

(3) The right of use within the agreed extend can only be granted after the complete payment of the license fees.

(4) Without the previous written consent of gameaudio.net the licensee doesn’t have the right to modify, edit or further develop the purchased music. This also applies in particular to remixes, samples, combination with other audio- or film-material.


§ 3 License types / kinds-of-use

Gameaudio.net offers the following license types. A usage which doesn’t fit the listed license types requires the previous written consent of gameaudio.net. For every license type the respective types of use are mentioned. Each kind-of-use has to be licensed seperately.


License A
- private internet content: Podcast/ Website/ Youtube, Webradio or
- up to 100 mechanical reproductions or
- commercial: Independent Games (sharing model: 10% of each download of App/Game go to gameaudio.net)

License B
- commercial internet content: podcast / websites / online-shop / Youtube, music on hold or
- games for mobile devices (like. iPhone, iPad and cell phones) or
- image film / product film (1 language / website / exhibitions & events) or
- TV-Shows, editorial film (online / TV / IPTV), corporate TV or
- up to 1.000 mechanical reproductions or
- App up to 10.000 Downloads

License C
- Internet commercial (1 language) or
- Commercial for local radio or cinema (license valid for 1 year) or
- up to 5.000 mechanical reproductions or
- App up to 25.000 Downloads

License D
- Point of Sale (POS) commercial national (license valid for 1 year) or
- Commercial for national radio or cinema (license valid for 1 year) or
- TV commercial regional (license valid for 1 year) or
- up to 10.000 mechanical reproductions or
- App up to 50.000 Downloads

License E
- TV commercial national (license valid for 1 year) or
- up to 10.000 mechanical reproductions or
- App up to 100.000 Downloads

§ 4 Other stipulations

(1) The laws of the Federal Republic of Germany applies, with the exclusion of UN sales law.

(2) The jurisdiction for all disputes on the grounds of or in connection with these license terms of gameaudio.net is – to the extent that this is legally permissible – Berlin.

(3) Should any of the provisions of these license terms agreed be or become void, the validity of the remaining parts of these terms shall not be affected.
